These Terms of Service govern your use of the MyEpitaph website and services. By creating an account or using our service, you agree to be bound by these terms. Please read them carefully — they outline your rights and responsibilities as a user of our platform.
Using Our Service
You must be at least 16 years of age to create an account. By registering, you confirm that the information you provide is accurate and that you will keep it up to date.
You are responsible for maintaining the security of your account credentials. Any activity that occurs under your account is your responsibility. Please notify us immediately if you suspect unauthorised access.
Memorial Content
Ownership: You retain full ownership of all content you upload to MyEpitaph, including photographs, written tributes, and biographical information. By uploading content, you grant us a limited licence to store, display, and distribute that content in accordance with your chosen privacy settings.
Responsibility: You are responsible for ensuring that you have the right to share any content you upload. This includes having permission from living individuals featured in photographs and respecting copyright on any materials you include.
Collaborative Memorials: When you invite others to contribute to a memorial, each contributor retains ownership of their individual contributions. The memorial creator maintains administrative control over the page and may moderate contributions.
Acceptable Use
MyEpitaph is a place of remembrance and respect. You agree not to:
- • Create memorial pages that are defamatory, harassing, or intended to cause harm
- • Upload content that is obscene, hateful, or violates any applicable law
- • Impersonate another person or create fraudulent memorial pages
- • Use the service for commercial advertising or spam
- • Attempt to access other users' accounts or private memorial pages without authorisation
- • Use automated tools to scrape or collect content from the platform
Memorial Permanence
We understand the importance of preserving memories for the long term. We commit to maintaining memorial pages for as long as our service operates. In the unlikely event that MyEpitaph ceases operations, we will provide at least 12 months' notice and offer a full data export to all users.
Memorial creators may delete a memorial page at any time. Once deleted, content is permanently removed from our servers within 30 days, except where backup retention policies require a longer period.
Account Succession
You may designate a trusted contact who can assume control of your account and memorial pages in the event that you are no longer able to manage them. This can be configured in your account settings. Without a designated successor, we will work with verified family members to ensure continued access to memorial content.
Fees & Payments
Basic memorial pages are free to create and maintain. Premium features, including extended media storage, custom domains, and advanced privacy controls, are available through paid plans. Prices are clearly displayed before purchase, and you may cancel at any time. Refunds are handled on a case-by-case basis.
Limitation of Liability
MyEpitaph is provided "as is" without warranties of any kind. While we take every reasonable measure to protect your content and ensure service availability, we cannot guarantee uninterrupted access. Our liability is limited to the fees you have paid for the service in the 12 months preceding any claim.
Changes to These Terms
We may revise these terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Your continued use of the service after changes take effect constitutes acceptance of the revised terms.
